Costco sues Trump administration over tariff refund eligibility

Investing.com -- Costco Wholesale Corp. has filed a lawsuit against the Trump administration to secure eligibility for tariff refunds if the U.S. Supreme Court strikes down the president’s global tariffs policy.

Costco’s complaint, filed on Thursday in the U.S. Court of International Trade, stems from uncertainty about whether refunds will be guaranteed for businesses that have paid duties if the Supreme Court declares the tariffs unlawful.

The company did not specify in its lawsuit how much Trump’s tariffs have cost it to date.

The nation’s largest warehouse club chain joined dozens of companies that have filed lawsuits in a U.S. trade court since late October challenging President Donald Trump’s use of an economic emergency powers law to impose the levies, court records show.

The Supreme Court heard arguments on Trump’s tariffs on November 5 and placed the case on a fast-tracked schedule, though no ruling date has been announced.

Costco argues it needs immediate court intervention because Customs and Border Protection denied its request to extend the schedule for finalizing tariff determinations under Trump’s use of the International Emergency Economic Powers Act. The company claims this could jeopardize its ability to seek full refunds in the future.
