Investing.com-- Elon Musk’s X Corp was allowed by a federal judge on Thursday to proceed with a lawsuit against Apple Inc (NASDAQ:AAPL) and OpenAI that accuses the two of attempting to create a monopoly in smartphones and artificial intelligence chatbots.
U.S. District Judge Mark Pittman in Fort Worth, Texas, on Thursday ruled against motions from Apple and OpenAI to dismiss the lawsuit from social media firm X and AI startup xAI.
Pittman, in a brief order, said the ruling did not count as a judgement on the merits of the litigation.
Musk’s firms, in an August lawsuit, had alleged that Apple violated antitrust law by exclusively choosing ChatGPT for its Apple Intelligence features on iPhones and other devices. The lawsuit claimed Apple had illegally disregarded rivals in its partnership with OpenAI.
The lawsuit also alleged that Apple reinforced this exclusivity by featuring ChatGPT on its “Must-Have Apps” list in the App Store, while sidelining rivals.
Apple had denied the allegations, while OpenAI had accused Musk of engaging in a pattern of harassment.
